Feeling Sad
My Appeal got denied .They said I am severe but I guess not severe enough receive disability. And I can do light work on a job . Feeling down They say I have 60 days to file another Appeal . I may get the same judge are I may get a different one

Did you have a lawyer? It probably doesn't help that you still have a job. A judge probably reasoned that if you have a job, you can still work or find a job that will allow you to continue to work. It is really a messed up system. They want people to be in a cardboard box on the street before they can get their first check. I would use that 60 days and see if a lawyer can help you unless you already have one. Lawyers really do help you get your disability and they only get paid a portion of your back pay if you win just in case you didn't know. You probably did since you have been fighting this for a good while. I am so sorry for the stress this must be causing you. It is times like this, you can just wish you can give your pain to that person for like 30 minutes and have them move around and try to function. They just don't get it. I hope you can get the answers you need on the second time around. It won't hurt you to appeal, right. Best wishes.

Is it your first time applying? I hear second time is a charm, and almost everyone gets denied the first time. Hang in there and try try again. So tiring though!

My brother in law just finally won his. The state's attorney threw a book on the table ad said there were thousands of jobs in there he could do, and the judge asked how many would allow him to lay down when he needed to? Case closed. He got his 3 years of back pay.

Yes I did have a representative and no I am not working. The judge was saying that I can do light duty work .

Jesswoo76 I got denied the first time so I appealed it and if I appeal,THIS Will Be The Second Appeal. I did have a lawyer . I dont think we are allowed to say who we used on here but .

I received my letter of denial yesterday so I will have to wait till Monday to call the lawyer and decide what's best for to next

I would have to agree. If you have to change reps and appeal again. There are hundreds of people who are falsifying there disae and get it in no time . it's sad that people like us who work out while life's have to suffer needlessly. Don't give up its gonna be ok. Appeal again I know its hard. My lawyer just told me my hearing is in 15 months. I was floored but I know I have a lo g road head of me so keep going. You got this.

Don't give up Everyone, , I have been denied 2 times and awaiting on a appeal my lawyer said Georgia have a back log until 16 to 18 months WOW Right.

I think many times they turn you down to see if you will return to work or let your spouse provide for you. I think they are taking a gamble on your determination. They want to see if you will hold out to get it. Just hang in there. I am sorry you are doing without the income of working. That must be hard. But I am sure it will go further in helping your case.

I had to appeal manytimes before I finally won with no Lawyer. Don't give up. It's what they hope you will do. They bank on that. You will eventually get it if you keep appealing.

Honeybun I'm sorry you got denied. I was denied 3 times before on the 4 try I got b it but they would only go bac 3 yrs.in backpay. My husband got his after only 14 months mainly I believe because his Dr helped him. Don't give up it will come through for you. Will be praying for you,sending hugs.

Honeybee I have been denied twice but have not yet been in front of a judge. Only the DDS has looked at my files. Not a judge. Hang in there. Keep appealing. It is either that or start over. Good luck.

Dear Honeybun,
I would like to support you with your ongoing struggled with disability. I don't know what country or state/province you live in. I realize that there are different types of disability insurance. Different companies or government will have their own "specific" criteria, law whether to be granted. Being denied is very common. For me it was and still is important for me to keep a journal of how I am feeling, research the problem and possible treatments, have questions ready for all my appointments, go over them after with the answers I got, keeping track of medications why you are on them and why they are discontinued, the conversations I have with Heath specialists, notes of who and when I have talked with regarding health benefits. My personal file is thick and continues to build. It's a crazy amount of work for me especially that I am not well. Where I live by law the disability company needs to tell you why you have been denied. This helped me with filing for the next time so that when appealing can be more fine tuned. If they don't tell you why, ASK why I am not being granted. ALWAYS keep within the time frame of the appeal!
A reality for me is that even on disability, I have to pay for medications and much of the treatments I get. This is not covered. Add rent, food, kids, etc. Sometimes options need to be weighed. Where I come from welfare covers medication, maybe able to help with housing, food. Many insurance companies or welfare get people to apply for disability so that they don't have to fork out the money, it's a common tactic. Doctors or others may say that you can get disability but have no firm knowledge or information to support this are not helpful, just giving false hope.
Lawyers have popped up in this conversation, I am not always sure this is the answer for everyone. They are not Gods who provide miracles. As the same with doctors and specialists. Maybe asking a doctor, support group or organization, or search on the internet for help of who they think can help fill out the papers.
Age is another factor and whether you can be retrained.
The third appeal I had an occupational therapist that helped me put into words the limitations that I have. Simple things I didn't even think about because it became not a part of my life. The papers and knowing I had been denied in the past was difficult for me.
If I lived in a cardboard box, that would make me homeless. That would likely mean that I would not have a mailing address, never mind having a phone. How would disability services, Doctors/ specialists get a hold of me?
