Getting ready for battle

Mar 14, 2015 1:35 PM

First off, I am a very non-confrontational person so that makes this whole workmans comp thing so stressful.
I suffered a lumbar/thoracic sprain/strain in January of 2014. I have been on with modification and off of work since.
The doctor said some people just don't heal like others and apparently that's me.
I have was sent to an IME appointment last July and at that point the IME doctors agreed with my doctor that I was not medically stationary and would benefit from further pt and treatment.

I have an mri w/o contrast, flat panel X-rays and now flex/ext X-rays that don't show anything that should be keeping me in the pain I have.

Then at the end of February my doc referred me for a consult to a specialist who was basically in agreement with my doc and also thought a flex/ext xray and possibly a bone scan would be in order.
The week after the specialist in February I was sent to another IME by Saif. This doctor seemed perplexed as to why I was even there because the specialist the week before can do IMEs also but he did a quick 35 minute question and exam.

His report came back saying arthritis is causing my pain. No one else has ever mentioned arthritis and the vertebrae he notes are not even where the tender points are on my spine.

I am on modified duty which my company has refused to let me work saying they don't have modified duty for me.

I'm thinking said will be sending a closure letter any day at which point I'm hoping a lawyer will say I have a case.

I'm also wondering since medical marijuana is legal in Oregon and will be legal for recreational use this summer , I'm also wondering if I can get a medical card before my case is settled?

Oregon wow they kind of have you in a tailspin. Hopefully you can get a medical card for mj. I wish Texas would vote to let it be used for medical here, but I don't see that happening any time soon.

The most frustrating part is that I'm still having back pain over a year later and the imaging doesn't show it. The doc can feel spasms and my range of motion is shot... I have some other issues in other areas of my body so all of that on top of the back issue is making me so anxious I'm ready to blow at any moment!
After I started Tizanidine the big spasms have subsided but now the other painful areas in my back are more prominent.

I feel like over a year later I'm probably going to have to learn to live with it. I just want this nerve wracking comp thing over!! Every person I've spoke with says workers comp is a nightmare and they are right!

You may want to check into disibility

Mar 14, 2015 6:53 PM

Yes workers comp is pain in the neck, and Whitehawk has a good suggestion about trying for disability. But that's another whole different nightmare. Be sure and get copies of all your records ,every Dr every chiropractor ' records, every MRI, Scan any and everything that has been done. Then get youa Good lawyer and be prepared for a fight and wait. Good luck

Oregon, I am so sorry you are going through this nightmare. It's true that disability is a nightmare all unto itself. I have to tell you that, as tough as it can be, you may have better success going in that direction. The majority of the doctors working on you had all the same diagnosis. I went through the frustration of having "normal" MRI, X-rays, etc. When my shoulder was killing me. I finally said to the doctor, you can't see a shoulder moving from the socket whilst lying on it and being immobile for the sake of the scans. I went to another doctor who took X-rays with me holding weights in each hand and also having my arm at my side, turning my thumb outward and then lifting my arm to take the next X-rays. Turns out after all of that, I had to have a 7-1/2 hour surgery to put my shoulder back together!! THAT was the beginning of my whole nightmare 21 years ago. Best of luck to you, Oregon.. I'll be praying for you that you get what you need. πŸ’•

Also had to sign a pain contract and pee in a cup. It irritates my doc that the insurance puts his patients thru this.

Oregon I know what you mean it's not only frustrating to our Drs, but us as well. My Dr, told me that It has added more paperwork to them as well as having to buy more scripts in triplicate.

Mar 15, 2015 7:54 PM

Hit the wrong button. But makes us have to go every month to get our meds filled. My Dr told me when I signed my agreement that if I missed my appointment that I would have to wait until time for my refill the next month, to get my script for my pain meds. They just made it difficult for those of us that really needs, and the dope heads can get on the streets.

I got screwed by a work comp injury and all I will say is ... Get a lawyer from the start!

Mar 16, 2015 7:46 PM

Thank you.... I called a WC lawyer yesterday and basically I need to just be patient and wait for the closure letter.... There is a twist midway thru this last year where my employer of 13 years ( of whom I went back to college on my dime for) removed 13 years of social service experience when I applied for another position, from my letter of recommendation that went to the council for decision. I feel like that could help me or hurt me as far as a WC hearing goes.

Mar 17, 2015 10:52 AM

Hang in there, Oregon.. I'll be praying for you. I hope you have a great lawyer and they take good care of you. Good luck. πŸ’•

Thank you! This stress makes me want to crawl under a rock or jump off a bridge!

Mar 17, 2015 11:06 AM

I hear you!!! I go to the doc tomorrow to see if I have a tumor in my inner ear or brain causing my hearing loss. I'm scared to death and it's making my pain worse, my head hurt and my ear is ringing so loud, it's almost drowning out other sounds. We'll make it through, Oregon... Hang in there!! 😊
