First off, I am a very non-confrontational person so that makes this whole workmans comp thing so stressful.
I suffered a lumbar/thoracic sprain/strain in January of 2014. I have been on with modification and off of work since.
The doctor said some people just don't heal like others and apparently that's me.
I have was sent to an IME appointment last July and at that point the IME doctors agreed with my doctor that I was not medically stationary and would benefit from further pt and treatment.
I have an mri w/o contrast, flat panel X-rays and now flex/ext X-rays that don't show anything that should be keeping me in the pain I have.
Then at the end of February my doc referred me for a consult to a specialist who was basically in agreement with my doc and also thought a flex/ext xray and possibly a bone scan would be in order.
The week after the specialist in February I was sent to another IME by Saif. This doctor seemed perplexed as to why I was even there because the specialist the week before can do IMEs also but he did a quick 35 minute question and exam.
His report came back saying arthritis is causing my pain. No one else has ever mentioned arthritis and the vertebrae he notes are not even where the tender points are on my spine.
I am on modified duty which my company has refused to let me work saying they don't have modified duty for me.
I'm thinking said will be sending a closure letter any day at which point I'm hoping a lawyer will say I have a case.
I'm also wondering since medical marijuana is legal in Oregon and will be legal for recreational use this summer , I'm also wondering if I can get a medical card before my case is settled?
