Got another denial

Oct 08, 2017 11:25 AM

So last week disability denied me again. I am so upset. That day I was a mess a broke down and when I called my lawyer I broke down on them. I've been trying to be patient with them and let them do there job. It's been 4 years I've been trying and my health has been declining all the while.
As I read through the judgement I found so many inaccurate things. I've got sticky notes and highlighter all over that document so I will remember and mention ever single wrong item.
The kicker here is the day to me. Ibam able to work 2 hours a day but am limited to a job where i use a hand held device. I'm like what the he'll kind of job is that.
Not to mention they accuse me of not pursuing physical therapy or excerises to help my condition . When in fact I've been in constant physical therapy for the last three years. I'm currently in a long term wellness program at the physical therapy location.
I just can't believe the unorganization if of it all.

I know exactly what you going thru, this month makes 4 years for me. I have been denied 3 times and then got denied another hearing. I had to start the process over again this past August. When I had my hearing they didn't even have the fact I was diagnosed with Sjögren's syndrome, fibromyalgia, osteoarthritis, chronic stomach pain, repeated kidney stones and kidney infections. They just had that I had depression and anxiety and it was my lawyers fault. Don't ever use one of those disability lawyers like citizens disability. Use a private firm. But I live in North Carolina and here in order to get Medicaid you have to file for disability and then Medicaid has to deem you disabled to get it if you are a single person with no children under the age 18 in the home. But the kicker is I finally won my hearing for Medicaid without a lawyer just me and my mom. And the same people that award Medicaid are the same people that award disability because they use the criteria of disability to base you getting Medicaid. So I hope I get awarded disability the first time around this time and I'm not using a lawyer because I can do a better job than them. I believe that sometimes a lawyer drips the ball gathering up all your health information because they send you the same medical release forms that disability is asking for. I can do that myself and I can get my doctor to fill out the forms asking them if I'm disabled. All the lawyer do is ask you everything that disability is asking.
Now from what I read that they are saying you can work 2 hrs a day with a hand held device. First of all I don't see how you can live off of a little check like that. And also you should still be able to get disability because you can work a part time job up to a certain amount of hours depending which state you live in. But forget all that you need to let them know how much your health has declined since you first filed for disability and give them even more recent health records if you have them.
I didn't have any healthcare at all since 2013, I did go to a university specialist for Rhuematology and got diagnosed with Sjögren's syndrome and fibromyalgia in 2015. I was unable to see all the other specialists and get medication I needed. It felt like my body was being tortured everyday till finally get Medicaid July of this year. So my health declined a lot, and I now have 10 specialists and I have to call disability tomorrow because I was going to a doctors appointment or MRI or bloodwork almost everyday. My appointments have now slowed up because they all have done they tests they needed. I just have to get a updated MRI on my back and knees. And all that I wanna make sure disability gets those records because they go off just the records you started with at the beginning when you applied they need each record every time you find out something new or different about your health issue. I have 3 herniated disk in my back from a prior MRI years ago but I know there is more going on cause it hurts worse.
I didn't mean to write so much but I hate when I see someone going thru the same issues I had with disability. I hope I helped some and I will be praying for you and sending hugs 💜💜💜

Thank you..ni worries on writing a lot the information was helpful. This was my first hearing denial and like you it's the lawyers fault. They had things all mixed up. And also the court says I was inconsitsnt in my responses. I'm like do you expect me to use the exact same words every time. As long as it all means the same thing.
My health also has gotten worse but they are assuming just because I had surgery to remove 20lbs of tumors that I should be better. Well maybe if the tumors had not compressed my bowels rectum and crushed the L5 disc in my hip causing bone and nerve compression with my t3 and t7 disc also being slipped . Plus...i donr see how they can punish me for not purchasing a 6000 dollar cpap machine. My insurance refused to cover it because I have very mild apnea. Barely a 1 on the scale of 1 to 10. The court said I was unimpressed and discontinued use. How can I discontinue something I never had. The whole thing is crazy and upsetting.but thank you for your input and I'm glad you fianly got award.
